These terms govern the use of the "farefisi" application (app and web service at farefisi.app), operated by Besnik Saiti, Lauetstr. 37, 8112 Otelfingen, Switzerland, contact: besnik.xperia@gmail.com (the "Operator"). By registering or using the service you accept these terms. Use is not permitted without acceptance.
farefisi is a private, free-of-charge service for recording and sharing family trees within closed family groups. There is no entitlement to availability, particular features, or continuation of the service. The Operator may change, restrict, or discontinue the service at any time; on discontinuation a reasonable period for data export is granted where feasible. The service is provided "as is", without warranties.
You must provide truthful information when registering and keep your credentials secret. You are responsible for all activity under your account. Accounts are non-transferable. The Operator may suspend or delete accounts for breaches of these terms.
You alone decide what content (names, life dates, places, relationships, links, and other details) you enter. You are aware that family-tree data regularly contains information about third parties (your relatives). You warrant that you are entitled to enter this information, in particular that no third-party rights (personality rights, data-protection rights) conflict, and that you inform affected relatives where necessary. You are solely responsible for all content you enter. The Operator does not adopt user content as its own and does not review it.
The following are prohibited in particular: entering knowingly false or defamatory information about third parties; any use for commercial, advertising, or surveillance purposes; attempts to circumvent security mechanisms, view other families, or disrupt the service (including automated bulk access); sharing invite links with people who do not belong to the family.
The Operator secures the data with appropriate technical means (including encryption) but gives no guarantee against data loss. The app always provides an export function (JSON/GEDCOM); you are responsible for making your own regular backups.
The Operator is liable without limitation only for intent and gross negligence, and for damage arising from injury to life, body, or health. Otherwise liability is excluded to the extent legally permissible; in particular the Operator is not liable for indirect damage, loss of use, data loss (subject to section 6), or damage from other users' content. For a free service the Operator is furthermore only liable for the care it applies in its own affairs.
You indemnify the Operator against all third-party claims — including reasonable legal-defence costs — arising from your content or your use of the service in breach of these terms. This applies in particular to claims by persons whose data you entered without authorization.
You may give up your account at any time (leave the family or request deletion from the Operator). The Operator may terminate the usage relationship with reasonable notice; the right to suspend for good cause (sections 3, 5) remains unaffected.
The Operator may change these terms with effect for the future (e.g. for new features or a changed legal situation). Changes are shown in the app and must be accepted again before the service can be used further for writing.
The law of the Operator's registered seat (Switzerland) applies; mandatory consumer-protection provisions of your country of residence remain unaffected. The place of jurisdiction is — where permissible — the Operator's seat. Should individual provisions be invalid, the remainder stays valid; the statutory rule replaces the invalid provision.

The family data entered by users is third-party content; the respective user alone is responsible for it (see Terms of Use section 4). The Operator is not obliged to monitor transmitted or stored third-party information. On becoming aware of legal violations, the Operator will remove the content concerned without delay.
The app does not link external content on its own responsibility; social-media links added by users lead to third-party websites whose content the Operator has no influence over.
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. The Operator is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration body.
